Schemes target large health care programs, both public and private, and are committed by health care providers, owners of medical facilities and laboratories. Health Care Fraud includes insurance, drug and medical fraud. Lara Merchan, Special Assistant Attorney General, NYS Office of the Attorney General

In her capacity as a Special Assistant Attorney General in the Medicaid Fraud Control Unit, Ms. Merchan has investigated and prosecuted hundreds of civil and criminal violations of law involving fraud by a variety of health-care providers, including doctors and nurses, transportation companies, pharmacies, durable medical equipment suppliers, rehab facilities and hospitals. Her criminal prosecutions and civil settlements have netted millions of dollars in recovery for the Medicaid Program and jail sentences for numerous providers. Ms. Merchan's presentation will include information of the audits and investigations routinely conducted by the NYS office of the Attorney General's Medicaid Fraud Unit.

Kenneth M. Abell, Partner Abell Eskew Landau

Immediately prior to founding Abell Eskew Landau, Ken was a partner and Chair of the Healthcare Fraud and White-Collar Criminal Defense Practice Group at one of the largest law firms on Long Island. Until 2018, Ken served as Chief of Healthcare Fraud for the United States Attorney's Office for the Eastern District of New York, Civil Division. In his ten years as an Assistant United States Attorney, Ken litigated and resolved some of the Eastern District's most significant fraud matters, successfully tried cases and argued numerous cases before the United States Court of Appeals for the Second Circuit. In investigating and prosecuting these actions, Ken worked closely with federal agents from the Department of Health and Human Services Office of Inspector General, the Federal Bureau of Investigation and the Food & Drug Administration.

Geoffrey R. Kaiser, Senior Counsel, Rivkin Radler

Geoffrey R. Kaiser who has extensive experience in enforcement matters affecting the healthcare industry, concentrates his legal practice on healthcare fraud and regulatory compliance issues, white collar criminal defense, False Claims Acts litigation, integrity monitoring, and internal investigations. As head of the Compliance, Investigations and White-Collar Practice Group, and senior counsel in the Health Services Practice Group, Jeff is frequently called upon to handle matters implicating a range of healthcare fraud and abuse laws, including the False Claims Act and the Anti-Kickback Statute. Before joining Rivkin Radler, Jeff served for nearly 10 years in the Criminal Divisions of the U.S. Attorney's Office for the Eastern District of New York and the U.S. Attorney's Office for the Southern District.

Benjamin P. Malerba, Partner, Rivkin Radler

Benjamin P. Malerba is a partner in the Health Services and Privacy, Data & Cyber Law Practice Groups. Ben counsels a cross-section of healthcare providers and facilities, including IPAs, ACOs, provider networks, ambulatory surgery centers, diagnostic and treatment centers, dialysis facilities, and hospitals and federally qualified health centers, on general healthcare business transactions, state licensing issues, corporate practice of medicine and fee-splitting prohibitions, regulatory compliance, disputes with managed care statues, and federal and state privacy laws. His practice also covers data breach and response, cybersecurity and data security, with a particular focus on security breaches related to Health Insurance Portability and Accountability Act of 1996 (HIPAA).
