Financial Abuse and the Elderly
Details: The seminar will begin with a background on elder fraud and abuse and how to protect the elderly through the execution of essential estate planning documents (including: Durable General Powers of Attorney, Health Care Proxies, Living Wills, Last Wills and Testaments, Trusts). The focus of the discussion will highlight the pitfalls of poorly executed documents, undue influence, financial misappropriation and the impact on the victim’s access to care and health insurance.
We will discuss using guardianship proceedings under NY law (those commenced in Supreme Court and Surrogate’s Court) to protect the elderly.
